How can I protect my company name?

Following the introduction of the Companies Act 1985 and more recently the Companies Act 2006, only businesses required to register their names with Companies House, mainly limited companies, can protect their name.

Companies House is the official public register of company names. This effectively means that if you are not a Limited Company, Limited Partnership, Public Limited Company or Limited Liability Partnership, you cannot register your name with any government agency. You can certainly find many online websites and various websites claiming to be a ‘name register’, but these are not government records.

An alternative option and one that provides additional protection of business names is to register a trademark. This is considerably more expensive and can be a complex task.
